Vestis Art AS (org.nr. 936 532 098), Ibsens Gate 52, 5053 Bergen, Norway ("Vestis Art", "we", "us", "our") operates vestisart.com. For the purposes of the General Data Protection Regulation (EU) 2016/679 ("GDPR") as implemented in Norwegian law, we are the data controller of your personal information.

1. Personal Information We Collect

Information you provide directly:

• Pre-order form: full name, email address, phone number, shipping address, postal code, t-shirt size
• Contact form: full name, email address, inquiry type, message content

Information collected automatically:

• IP address, browser type, device type, pages visited, and time on site — collected via the analytics tools listed in Section 4

Payment information:

When arranging payment, transaction data is processed directly by Stripe, Vipps, or PayPal. We do not store, process, or have access to full payment card details.

3. Data Retention

Pre-order data is retained indefinitely for business record-keeping. Contact form data is retained for up to 24 months from submission, or until the matter is resolved. You may request deletion at any time subject to any overriding legal obligations we may have to retain the data.

4. Third Parties We Share Data With

We do not sell your personal information. We share data only with the following service providers as necessary to operate our services:

*TikTok may transfer data to servers outside the EEA, including the People's Republic of China. By consenting to analytics cookies you acknowledge this transfer. You may withdraw consent at any time. All other transfers outside the EEA are protected by Standard Contractual Clauses (SCCs) or an applicable adequacy decision.

5. Your Rights Under GDPR

You have the right to:

6. Minors

Our Services are intended solely for users who are 18 years of age or older. We do not knowingly collect personal information from minors. If we become aware that personal data has been submitted by a person under the age of 18, we will delete it promptly. Vestis Art AS bears no responsibility for any use of the Services by persons under the legal age, and it is the sole responsibility of the parent or legal guardian to supervise their minor's internet use.

7. Changes to This Policy

We may update this Privacy Policy at any time. The revised version will be posted at vestisart.com/legal with an updated "Last updated" date. Continued use of the Services following any change constitutes acceptance of the revised Policy.

1. Acceptance of Terms

By accessing or using vestisart.com and any related services (collectively, the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Services. Vestis Art AS reserves the right to modify these Terms at any time. Continued use of the Services after any modification constitutes acceptance of the updated Terms.

2. Eligibility and Age Requirement

The Services are intended exclusively for individuals who are 18 years of age or older and legally capable of entering into binding agreements. By using the Services, you represent and warrant that you meet this requirement.

Vestis Art AS accepts no liability whatsoever for any use of the Services by persons under the legal age of majority. If you are under 18, you are strictly prohibited from using the Services, placing a pre-order, or submitting any personal information. Any agreement entered into by a minor is void. It is the sole responsibility of the parent or legal guardian to prevent minors from accessing the Services.

3. Pre-Order Terms

• All purchases through vestisart.com are made on a pre-order basis. No payment is collected at the time of placing a pre-order.
• A pre-order constitutes an expression of interest, not a binding purchase contract. A binding contract is only formed when Vestis Art AS confirms your pre-order in writing and payment has been successfully arranged and received.
• Vestis Art AS reserves the right, at its sole discretion, to cancel, decline, or modify any pre-order at any time prior to the formation of a binding contract, without liability.
• Prices are displayed in Norwegian Krone (NOK) and are subject to change without notice prior to the formation of a binding contract.
• Once a binding contract is formed, your statutory consumer rights under Norwegian law (forbrukerkjøpsloven) apply in full.

4. Intellectual Property

All content on vestisart.com — including but not limited to artwork, designs, photographs, text, logos, and graphics — is the exclusive property of Vestis Art AS or its licensed artists and is protected by Norwegian and international intellectual property law. You may not reproduce, distribute, modify, publish, transmit, create derivative works from, or in any way exploit any content from the Services without prior written consent from Vestis Art AS.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• Vestis Art AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Services.
• Vestis Art AS makes no warranty that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
• Vestis Art AS is not responsible for any loss or damage arising from your reliance on information contained on the website, including product descriptions, pricing, or availability.
• Our total aggregate liability to you shall not exceed the amount paid by you, if any, in the six (6) months preceding the event giving rise to the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under Norwegian or EU law.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.

7. User Conduct and Responsibility

By using the Services you agree not to:

• Use the Services for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Infringe any intellectual property or other rights of Vestis Art AS or third parties
• Attempt to gain unauthorised access to any part of the Services
• Engage in any conduct that could damage, disable, or impair the Services

Vestis Art AS bears no responsibility for the conduct of any user and shall not be held liable for any actions, omissions, or behaviour of any user of the Services. You are solely responsible for your own use of the Services and any consequences thereof.

8. Third-Party Links and Services

The Services may contain links to third-party websites or services. Vestis Art AS has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites. Your use of third-party services is governed solely by their respective terms.

9. Force Majeure

Vestis Art AS shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, war, natural disasters, strikes, supply chain disruptions, pandemics, or government action.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Norway. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bergen, Norway, with Bergen tingrett as the venue of first instance.

11. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Refund Policy

All sales made through vestisart.com are final. As all garments are produced on a made-to-order basis following confirmation of your pre-order, Vestis Art AS does not accept returns or exchanges for change of mind, incorrect size selection, or other reasons within your control — subject to the statutory rights set out below.

1. Your Statutory Rights

Nothing in this policy limits or excludes your rights under Norwegian law (forbrukerkjøpsloven) or the EU Consumer Rights Directive, which apply in full and cannot be waived. This policy operates in addition to, and does not restrict, your statutory rights as a consumer.

2. Defective, Damaged, or Incorrect Items

You must inspect your order upon receipt. If your item is defective, materially damaged in transit, or if you have received the wrong item, you must notify us within 14 days of receipt at dagligleder@vestisart.com with:

• Your order confirmation or proof of purchase
• A clear description of the defect or issue
• Photographs documenting the defect or damage

Upon verification, we will, at our sole discretion, offer repair, replacement, or a full refund. We reserve the right to request return of the item before processing any remedy. Failure to notify us within 14 days of receipt may result in the claim being denied.

3. EU/EEA 14-Day Right of Withdrawal

If you are a consumer resident in the EU or EEA (including Norway), you have the statutory right to withdraw from your purchase within 14 calendar days of receiving the item, without providing a reason, under the EU Consumer Rights Directive and Norwegian angrerettloven.

To exercise this right, notify us in writing at dagligleder@vestisart.com within the 14-day period. The item must be:

• Returned in its original, unused, unworn condition
• With all original tags attached
• In its original packaging
• Accompanied by proof of purchase

You are responsible for return shipping costs unless the item is defective or incorrect. We reserve the right to refuse a return or deduct an amount from the refund if the item shows signs of use, damage, or missing components not caused by us.

4. Non-Returnable Items

The following are not eligible for return or refund:

• Items that have been worn, washed, or altered in any way
• Items without original tags or packaging
• Items returned outside the applicable return window
• Items damaged due to misuse, negligence, or improper care by the customer

5. Refund Process

Once we receive and inspect your returned item, we will notify you of the outcome within 5 business days. If approved, your refund will be processed to your original payment method within 10 business days of approval. Please allow additional time for your bank or payment provider to post the refund.

If more than 15 business days have passed since your return was approved and you have not received your refund, please contact us at dagligleder@vestisart.com.

6. Limitation

Vestis Art AS's maximum liability in connection with any return or refund shall not exceed the original purchase price paid for the item in question. We are not liable for any consequential, indirect, or additional losses arising from a defective or incorrect item beyond the remedy outlined above.
